Officer Compliant Form | The Nassau Bay Police Department strives to provide a professional and ethical service to all citizens and members of our community. To ensure concerns regarding ethics and integrity are properly investigated, the Department developed a complaint process. The process is designed to investigate concerns involving any Departmental procedural issues, Police personnel complaints and or any other related Police provided services.
NOTE: Traffic ticket issues or differences of opinion between officers and citizens over the issuance of the traffic ticket will not be investigated unless there is a specific allegation of misconduct against members of the Department. The merit of the traffic violation itself will be determined in municipal court by the presiding magistrate.
The Complaint Process
Texas State Law (Govt. Code 614.022) requires that all complaints against police officers be in writing and signed by the person making the complaint. The person who claims to be aggrieved must make the complaint; other persons may give statements as witnesses.
Texas Government Code § 614.023. Copy of Complaint to be Given to Officer or Employee
(a) A copy of a signed complaint against a law enforcement officer, fire fighter, or police officer shall be given to the officer or employee within a reasonable time after the complaint is filed.
(b) Disciplinary action may not be taken against the officer or employee unless a copy of the signed complaint is given to the officer or employee.
Texas Penal Code § 37.02. Perjury
(a) A person commits an offense if, with intent to deceive and with knowledge of the statement's meaning:
(1) he makes a false statement under oath or swears to the truth of a false statement previously made and the statement is required or authorized by law to be made under oath; or
(2) he makes a false unsworn declaration under Chapter 132, Civil Practice and Remedies Code.
(b) An offense under this section is a Class A misdemeanor.
Complaints are made by filling out a complaint form. Click the following blue "Complaint Form" The complaint form document must be printed, completed, and returned in person to the Nassau Bay Police Department. Most complaints are investigated and resolved within 14 business days. Following the review and investigation the complainant will be notified in writing of the final disposition within 45 days.
Possible Dispositions:
Sustained Complaints
Actions against an employee for sustained misconduct may range from counseling or retraining to suspension or termination. Consideration is given to the seriousness of the misconduct and the employee's historical performance within the Department.
Unfounded Complaints
Complaints must be supported by sufficient evidence. If there is not sufficient evidence to sustain the complaint, the officer is notified and continues on duty.
Procedural Deficiency
The Department recognizes an internal deficiency that can be corrected to improve overall service and efficiency.
